Bump Terms of Service

Effective Date: March 5, 2026

These Terms of Service ("Terms") govern your use of the Bump mobile application ("App") operated by Bump ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 17 years old and a current student, faculty member, or staff member at Western University (UWO) to use Bump. You must register with a valid UWO email address (@uwo.ca) and complete the verification process.

2. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.

3. How Bump Works

Bump uses Bluetooth Low Energy (BLE) to detect when two users are in physical proximity. When a "bump" occurs:

• An ephemeral conversation is created between the two users, lasting 30 hours.
• If neither user adds the other as a friend, the conversation expires and messages are deleted.
• If both users become friends, the conversation becomes permanent.

You understand that using Bump requires enabling Bluetooth and, on Android, allowing a foreground service to run for background detection.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Harass, bully, threaten, or intimidate other users
• Send spam, unsolicited messages, or abusive content
• Impersonate another person or misrepresent your identity
• Attempt to reverse-engineer, decompile, or tamper with the App
• Exploit BLE advertising to track, stalk, or surveil other users
• Create multiple accounts or use automated means to interact with the App
• Share content that is illegal, hateful, sexually explicit, or violates the rights of others

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion.

5. Anti-Spam Protections

To maintain a positive experience, Bump limits the number of messages you can send before the other person replies. Attempting to circumvent these protections may result in account suspension.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Bump and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

8. User Content

• You retain ownership of content you create (messages, profile information, photos).
• By posting content, you grant us a limited, non-exclusive license to use, display, and transmit that content as necessary to operate the App.
• We may remove content that violates these Terms without notice.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• The App will be uninterrupted, error-free, or secure
• BLE detection will work in all environments or with all devices
• Any particular encounter or connection will occur

You use the App at your own risk. We are not responsible for the conduct of any user, whether online or offline.

10. Limitation of Liability

To the maximum extent permitted by law, Bump and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, goodwill, or other intangible losses, arising from your use of or inability to use the App.

11. Indemnification

You agree to indemnify and hold harmless Bump and its founders, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (e.g., limitation of liability, indemnification) will remain in effect.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Ontario.
